Terms Of Service - Revised July 03, 2025

  • 1. "YES, DO THIS WORK"
    I hereby authorize the corresponding service to be done along with the necessary materials.
  • 2. "YOU MAY DRIVE MY CAR ON PUBLIC ROADS"
    C&M Mobile Automotive Repairs - staff may operate my vehicle for the purpose of testing, inspection, and delivery. To comply with U.S. and North Carolina motor vehicle laws, any vehicle operated on public roads by C&M Mobile Automotive Repairs LLC must display a valid license plate with current registration. This includes vehicles from any U.S. state and is not limited to vehicles registered in North Carolina. Without valid registration, C&M technicians are prohibited from driving the vehicle outside of the customer's property. If a false or incorrect registration or license plate sticker is present on the vehicle, the customer accepts full responsibility for any legal consequences. C&M Mobile Automotive Repairs LLC is not liable, as the company has no way of verifying the authenticity or accuracy of the vehicle's registration or license plate. This policy ensures compliance with legal requirements and protects both C&M and the customer from liability. Failure to provide valid registration may result in delays or limitations in the services provided. C&M Mobile Automotive Repairs LLC maintains an active insurance policy that covers customer vehicles and property during the course of service and operation. However, all customers are required to maintain valid personal auto insurance on their vehicles at all times. This dual coverage ensures mutual protection and aligns with North Carolina state requirements.  
  • 3. "NO PAYMENT, NO KEYS"
    An express lien is acknowledged on my vehicle to secure the amount of services thereto. This approval also authorizes payment for the approved amount. Failure to pay may result in an express mechanic's lien being enforced in accordance with North Carolina General Statutes § 44A-2, which may include the vehicle being towed and stored at a designated facility until full payment is made. The customer agrees to pay all towing, storage, repositioning fees, boot fees, and any boot removal fees associated with this process.  
  • 4. "ONLINE COMMUNICATION OK"
    I welcome email from C&M Mobile Automotive Repairs LLC - as a means of receiving copies of my estimate, work order, and invoice. I also consent to receive marketing communications from C&M, including promotional offers, email and text updates regarding scheduled closures, service reminders, and other business-related notifications.
  • 5. "HERE'S MY SIGNATURE"
    I acknowledge that the attached digital image of my signature is equivalent to my handwritten signature and serves as valid proof of my agreement to the thirty-seven terms (1–37) outlined herein.
  • 6. "LABOR RATE"
    Labor Rate $125.00 Per Hour
  • 7. "REFUNDS/ WARRANTY"
    No Warranty on Items Stated (NW), 12-Month/12,000-Mile Warranty (whichever comes first). Warranty is only valid from the initial repair order date and mileage. C&M Mobile Automotive Repairs LLC reserves the right to void any warranty at any time. C&M Mobile Automotive Repairs LLC may issue a refund once a refund addendum is completed. C&M Mobile Automotive Repairs LLC’s warranty is only valid if the vehicle is located within a 25-mile service area of Mecklenburg County and within the state of North Carolina. Sublet items are non-warranty with C&M Mobile Automotive Repairs LLC. All sublet warranty claims are to be submitted to the sublet repair facility. This Limited Warranty does not cover any damage to your car caused by abnormal use (such as use in a commercial venture), misuse, neglect (such as not performing maintenance services in accordance with the instructions in the owner’s manual for your car), alteration or tampering, or by external causes (such as accidents, fire, water, or freezing). Any diagnostic or inspection service, including pre-purchase inspection services provided through C&M Mobile Automotive Repairs LLC, has no warranty. This Limited Warranty does not cover any issues unrelated to the Vehicle Services ordered by you (e.g., if you order an alternator replacement because your car was not starting, and the car continues not to start after the alternator is replaced, this Limited Warranty does not cover the fact that the car does not start). It does not cover any pre-existing condition with your car that is not known by the Technician prior to starting the Vehicle Services and that is discovered during or after the Vehicle Services are performed (e.g., if you engage the Technician to replace valve cover gaskets, but during the removal of the valve covers, worn plastic hoses break because they are old and brittle; repairing and/or replacing the plastic hoses under that scenario would not be covered by this Limited Warranty). This warranty does not cover any repairs that you request the Technician perform beyond those included in the Technician’s diagnosis of the problem, even if those additional repairs are needed to fix the issue you asked the Technician to diagnose; provided, however, that if you authorize and pay for additional repairs through C&M Mobile Automotive Repairs LLC, such additional repairs would be included in the Vehicle Services and covered by this Limited Warranty. This warranty does not cover any consequential effects of the Vehicle Services performed, unrelated to any of the parts replaced being defective or any of the repair work being done incorrectly (e.g., if you request a transmission fluid service, but because you have not been replacing the transmission fluid regularly, when the Technician replaces the fluid with the correct fluid installed properly, your transmission stops shifting properly because it cannot handle the new fluid—this is a “consequential effect” not covered by this Limited Warranty). This Limited Warranty is entirely void when any parts not ordered through C&M Mobile Automotive Repairs LLC are installed by the Technician; any Vehicle Service request is made by you that deviates from a manufacturer’s recommendation (e.g., conventional oil is requested by you for an oil change, but the owner’s manual for your vehicle calls for synthetic oil). The Limited Warranty is also void if, after receiving the Vehicle Services, you take your car to a person not scheduled and processed through C&M Mobile Automotive Repairs LLC to diagnose or repair a problem believed to be associated with such Vehicle Services without giving C&M Mobile Automotive Repairs LLC the first opportunity to inspect and remedy the problem or to consent to an alternative person or shop doing so. Our oil change services include a limited warranty valid for six (6) months or 5,000 miles, whichever comes first. This warranty applies to non-commercial vehicles only and covers issues directly related to the oil change service provided. It does not cover any fluid leaks, engine damage, or other mechanical failures unrelated to the oil change, including but not limited to pre-existing conditions or wear and tear. For commercial vehicles, no warranty is provided, as the vehicle’s usage may exceed the design specifications and intended operating conditions. Any determination of whether this Limited Warranty does not apply or is otherwise void as to a particular warranty claim shall be made by C&M Mobile Automotive Repairs LLC in its sole discretion. You will be charged for one hour of labor fees if a service call is made under this Limited Warranty for an alleged defect determined not to be the result of a defect in materials or workmanship of the Vehicle Services. You must pay for any non-warranty service ordered at the same time as any warranty service.  
  • 8. "CUSTOMER SUPPLIED PARTS"
    (CSP) Customer supplied parts have no parts or labor warranty (No Warranty)
  • 9. "CREDIT CARDS AND OTHER PAYMENTS"
    For Credit Cards, Cash-app and Venmo, a surcharge of up to 3.75% will be charged on all transactions to the extent not prohibited by applicable law. To cover the cost of processing a credit or charge card transaction, and pursuant to applicable federal and North Carolina law, a surcharge of up to 3.75% may be applied unless prohibited by law. A seller or lessor shall not impose a processing surcharge on payments made by use of cash, a check or redemption of a gift card. (fee will be applied at time of sale) This fee is incorporated with "Shop Supplies". In accordance with North Carolina state law, customers are required to sign a "Credit Card Authorization Form" for all credit card transactions. This is a mandatory requirement. Failure to sign the form will result in no service being provided. If service has already been completed, refusal to sign the authorization may result in an "express mechanic's lien" being placed on the vehicle. In such cases, the business reserves the right to enforce a "No Payment, No Keys" policy, as outlined in Terms 3 and 25 of our terms and conditions.  
  • 10. "DIAGNOSTIC FEES"
    Diagnostic Fee(s) include One hour of diagnostic testing. Additional labor may be required for specific tests. C&M Mobile Automotive Repairs LLC reserves the right to "VOID" any diagnostic job at any time. Additional diagnostic time may be required for proper diagnosis and labor will be charged at C&M Mobile Automotive Repairs LLC hourly labor rate ($125.00). C&M Mobile Automotive Repairs LLC requires authorization on any additional labor. Failure to agree to additional labor may result in a "VOID" diagnostic and you "The Consumer" are still required to pay agreed upon diagnostic charges. Failure to pay a diagnostic charge may result in "An express lien" see term "3" on C&M Mobile Automotive Repairs LLC "Terms and Conditions" page. No warranty on any "Diagnostic(s) performed by C&M Mobile Automotive Repairs LLC.  If C&M Mobile Automotive Repairs LLC provides the parts and the vehicle has had a diagnostic completed within the last 30-days C&M Mobile Automotive Repairs LLC will apply a $50.00 credit towards the needed repair(s). ($50.00 can only be applied to the same vehicle). Limit one $50.00 credit per appointment/vehicle. All above prices are subject to taxes and other applicable fees. The $50.00 Credit expires, 30-Days from the initial quote date.
  • 11. "FUEL"
    C&M Automotive Repairs LLC, requires vehicles to have 1/4 tank of fuel for all repairs, this ensures that proper testing may be performed if needed. This is also needed for a safe test drive. Vehicles that do not have a minimum of 1/4 tank of fuel may be subject to a "Fuel Surcharge" of current fuel prices. C&M Automotive Repairs LLC may upcharge fuel up to 20% of fuel listed price.
  • 12. "BOOKING FEES"
    C&M Automotive Repairs LLC, requires all customers to pay a $50.00 Non-Refundable appointment booking/Scheduling fee. This fee is applied to the scheduled appointment. If the appointment date and or time is changed (by the customer) the scheduling fee will not be applied to the new appointment date and time, and a new $50.00 Non-Refundable fee will be required and will be applied to the new scheduled appointment. Only one $50.00 booking fee will be applied to the scheduled appointment. If customer(s) request a cancellation, a new booking fee will be required at the time of scheduling a new appointment. No refunds will be given if a customer(s) cancel a scheduled appointment. C&M Mobile Automotive Repairs LLC has the right to reschedule an appointment at any time. If C&M Mobile Automotive Repairs LLC Reschedules an appointment a refund may be issued, this Refund will be at management's discretion. No refunds will be issued due to inclement weather. In accordance with North Carolina state law, customers are required to sign a "Credit Card Authorization Form" for all credit card transactions. This is a mandatory requirement. Failure to sign the form will result in no service being provided. If service has already been completed, refusal to sign the authorization may result in an "express mechanic's lien" being placed on the vehicle. In such cases, the business reserves the right to enforce a "No Payment, No Keys" policy, as outlined in Terms 3 and 25 of our terms of service.
  • 13. "APPOINTMENT TIMES"
    C&M Mobile Automotive Repairs LLC is appointment based only. Appointment times vary with being mobile; we allow up to one hour past scheduled appointment time for the technician to arrive.
  • 14. "CANCELATION"
    You may cancel a scheduled appointment at any time, subject to the following. If you cancel any scheduled job, you will lose the "Booking Fee" if no booking fee was paid prior to the scheduled appointment, you will be charged a $50.00 cancellation fee for the technician's time. C&M Mobile Automotive Repairs LLC, reserves the right to establish, remove and/or revise our cancellation policy or cancellation fees at any time in our discretion.
  • 15. "PHOTOS AND VIDEOS"
    C&M Mobile Automotive Repairs LLC, will take photo/video documentation of all "New" and "Used" parts thus ensures all work was completed, C&M Mobile Automotive Repairs LLC, may take photos/videos of the vehicle, this includes but is not limited to, Tags, Interior, Exterior of the vehicle. Photos/videos may be used to determine warranty issues and pre-existing damage to a vehicle. As of February 19, 2024, all C&M Mobile Automotive Repairs LLC employees are required to wear and have "Body Cameras" on and recording audio and video of all appointments, during the duration of all customer interactions and work being completed to any vehicle. Thus be used to determine warranty issues, workmanship issues and pre-existing damage to a vehicle. Thus also ensures that all work was completed properly. Videos will not be shared publicly without written consent from "Customer(s)". All photos/videos may be shared with insurance companies, warranty companies and may be used in a court of law.
  • 16. "AFTERPAY"
    C&M Mobile Automotive Repairs offers "Afterpay" payment options for all customers. For all "Afterpay" questions please visit- https://help.afterpay.com/
    (If "Afterpay" is used on any invoice a 6.00% processing fee will be added at the time of sale.) By choosing Afterpay as a payment method for services or goods rendered by C&M Mobile Automotive Repairs LLC (“C&M”), you acknowledge and agree to the following terms: All payments made through Afterpay are final. Refunds will not be issued for financed purchases under any circumstance. In the rare event of a service issue or warranty concern, C&M may offer a store credit toward future work, as determined by the company’s service policies. You agree not to dispute any charge or payment with Afterpay, your credit card issuer, or bank once services have been completed or goods have been delivered. This ensures timely and fair compensation for labor and parts supplied by C&M Mobile Automotive Repairs LLC. All financed services and estimates must be approved in writing via Shop-Ware, C&M’s digital service platform. Once approved, you are contractually bound to the terms of the agreement and liable for full payment. All terms are enforceable under the laws of the State of North Carolina. By agreeing to this policy, you consent to resolve all legal disputes within the jurisdiction of Mecklenburg County, NC.
  • 17. "BATTERY WARRANTY"
    No Warranty on Items Stated (NW), 12-Month/12,000-Mile Warranty (whichever comes first). Warranty is only valid from the initial repair order date and mileage. C&M Mobile Automotive Repairs LLC reserves the right to void any warranty at any time. (Battery manufacturers offer up to a 5-year warranty. Please contact the battery manufacturer to determine the specific warranty for the parts installed.) For battery-related warranty claims, the vehicle must have adequate mileage and use from the time of installation. For example, if C&M Mobile Automotive Repairs LLC installs a battery and you initiate a warranty claim three weeks later but the vehicle has not been driven, and it is found that a security system has continuously drawn power while keeping the vehicle locked, C&M is not responsible for a dead battery under these conditions. We recommend driving the vehicle for at least one hour each week to maintain the battery's health, as well as to keep fluids and other electronic components in good condition. Important Warranty Continuation Note: If a warranty claim is approved and remedial repair work or part replacement is performed, the original 12-month/12,000-mile warranty period does not restart. The warranty coverage remains based on the date and mileage of the initial repair order.
  • 18. "ALIGNMENTS'
    C&M Mobile Automotive Repairs LLC, does not offer warranty of alignments on any vehicle. This includes all sublet alignments.
  • 19. "TIRES"
    C&M Mobile Automotive Repairs LLC, does not offer "Road Hazard", or any tire warranties; all tire warranties are to be taken up with the tire manufacturer.
  • 20. "QUOTES"
    All vehicle repair quotes (EXCLUDING TIRES) are valid for 30-Days from the initial quote date. Tire quotes are valid for 15-Days from the initial quote date.
  • 21. "BRAKES"
    All brake warranties are for pad(s) and rotor(s) and or brake shoe(s) and brake drum(s). No warranty can be used on "PADS" if no new rotor(s) and or drum(s) are installed. Just installing brake pads can cause an increase in brake "DUST" and or brake "NOISE" all brake warranties are VOID if just pads are installed. Important Warranty Continuation Note: If a warranty claim is approved and remedial repair work or part replacement is performed, the original 12-month/12,000-mile warranty period does not restart. The warranty coverage remains based on the date and mileage of the initial repair order.
  • 22. "A/C WARRANTY"
    No Warranty on "Evac and Recharge" for an A/C diagnostic. No Warranty on "Evac and Recharge" for an A/C system, this includes post repairs that are "first steps only". All items that are not included in an "A/C KIT" are subject to no warranty unless otherwise documented on the repair order by C&M Mobile Automotive Repairs LLC. No A/C Warranty is valid without a complete system A/C "FLUSH". Important Warranty Continuation Note: If a warranty claim is approved and remedial repair work or part replacement is performed, the original 12-month/12,000-mile warranty period does not restart. The warranty coverage remains based on the date and mileage of the initial repair order. Additionally, A/C diagnostic services carry no warranty, as the nature of A/C system failure often requires multiple steps to identify leaks or performance issues. Most diagnostics include the addition of ultraviolet (UV) dye to assist in locating leaks, which may take time to appear. A follow-up inspection may be required to properly determine the source of the issue. This additional inspection is not included in the initial diagnostic fee and may incur a separate charge.
  • 23. "WORK AREA"
    You agree to treat Technicians courteously and lawfully, to provide a safe and appropriate working environment that follows all applicable laws and regulations, and to provide reasonable cooperation to enable Technicians to complete the requested/required job. It is the sole responsibility of the customer to verify with any relevant third parties—such as apartment complex management, HOAs, landlords, or property owners—that mobile repair work is permitted on the premises. If C&M Mobile Automotive Repairs, LLC (“C&M”), or its subcontractors, are asked to vacate the property before the job is completed, the vehicle may be left in an unfinished or partially disassembled state. In such cases, the customer remains fully responsible for payment of all previously approved service charges, regardless of completion status. Furthermore, if a C&M employee or subcontractor is towed, booted, or cited while performing services on your behalf, the customer shall be solely responsible for all associated costs, including but not limited to towing, boot removal fees, citations, and any damage to C&M property resulting therefrom. Customers are also required to pay any parking fees or charges where paid parking is enforced.
  • 24. "WARRANTY CLAIM"
    Once you file a claim with us, our claims team will evaluate the claim to determine preliminary eligibility for coverage of Vehicle Services under this Limited Warranty. If eligible, we will send a technician to inspect the problem. If the Technician determines that there is a defect in materials or workmanship of the Vehicle Services and we elect to perform remedial service work and/or replace defective part(s) installed (instead of providing a refund), we will create a new appointment to perform such work and/or replace such part(s) at no cost to you.
    If the Technician determines that the claimed defect is not the result of a defect in materials or workmanship of the Vehicle Services, you will be charged for one hour of labor fees. All defective parts replaced under this Limited Warranty must be returned to us. By starting a warranty claim you agree to a diagnostic fee of $150.00 (Plus tax and fees). This fee may be adjusted after the initial warranty inspection. If the warranty inspection is within the 12-month 12,000-mile service period and the issues are part failure and or a workmanship issue you may not be charged. If the issues are unrelated to the previous repair(s)/ you will be charged for one hour of labor fees if a service call is made under this Limited Warranty for an alleged defect determined not to be the result of a defect in materials or workmanship of the Vehicle Services. You must pay for any non-warranty service ordered at the same time as any warranty service.

    Documentation: Please attach all relevant documentation supporting your claim including photos or video of the problem occurring with your vehicle. Please note, however, that attempting to fix the problem or touching the work performed by C&M Mobile Automotive Repairs LLC will immediately void your Limited Warranty. (All warranty claims must be started by you "The consumer" and must follow the above steps to ensure the warranty claim process is followed). Once a warranty claim is filed a warranty specialist will contact you within 24 business hours. Thus, not to include "Holidays" and/or days that C&M Mobile Automotive Repairs LLC is "Closed" for any reason. Failure to follow the "Warranty Process" as listed above will void all warranties with C&M Mobile Automotive Repairs LLC. Refer to term "7" Listed above for further information. Important Warranty Continuation Note: If a warranty claim is approved and remedial repair work or part replacement is performed, the original 12-month/12,000-mile warranty period does not restart. The warranty coverage remains based on the date and mileage of the initial repair order.
  • 25. "MECHANIC LIEN"
    An express lien is acknowledged on my vehicle to secure the amount of services thereto. A mechanic's lien is a security interest in the title to property for the benefit of those who have supplied labor or materials that improve the property. The lien exists for both real property and personal property. By agreeing to term 25 of C&M Mobile Automotive Repairs LLC terms and conditions you, the consumer, understand/ "NO PAYMENT NO KEYS" (Term 3); in addition the vehicle may be towed and booted at the owner's expense, until outstanding agreed upon balance is paid in full.
  • 26. "SHOP SUPPLIES"
    This mandatory fee covers the costs associated with the safe handling and disposal of environmentally sensitive materials, including solvents, cleaners, small quantities of fluids, rags, and waste oil. Additionally, this fee accounts for any credit card processing charges. Please note that this fee is non-negotiable and will be included on every C&M Mobile Automotive Repairs LLC invoice. For more details on credit card fees, refer to "Term 9" in the C&M Mobile Automotive Repairs LLC Terms and Conditions.  
  • 27. "PRE-PURCHASE AND POST-PURCHASE VEHICLE INSPECTIONS"
    Pre-Purchase and Post-Purchase Vehicle Inspection Disclaimer: A pre-purchase inspection is a comprehensive evaluation of a vehicle’s condition, performed before purchase to help you make an informed decision. This process includes a thorough assessment of key systems such as the engine, transmission, brakes, suspension, and overall safety, providing insights into the vehicle's current state. Important Notes: - This inspection is not a guarantee of the vehicle’s condition. - Inspection results may change if the vehicle is sold, test-driven, or used after the inspection. - C&M Mobile Automotive Repairs LLC is not responsible for any issues not identified during the inspection. Payment and Scheduling: - The full price of the pre-purchase inspection must be paid prior to booking your appointment. - Inspections typically take between 1.5 to 3 hours, and prepayment ensures that C&M does not lose time if the vehicle is sold before the appointment. - Prepayment is also required to ensure that if you are unhappy with the inspection results, you cannot refuse payment. This policy ensures C&M’s technicians are fairly compensated for their time and expertise. Additional Details: - A quote for any identified repairs will be created and sent to you for review. - C&M cannot negotiate pricing on your behalf and will not discuss inspection findings with the Seller. - Test drives are conducted at the Seller’s discretion and may not always be allowed. C&M will attempt to test-drive every vehicle, but due to insurance and state laws, this may not always be possible. - If the technician determines the vehicle is unsafe to drive, they will decline the test drive, and a detailed explanation will be included in your inspection report.   • 28. "THIRD PARTY WARRANTY COMPANIES"
    -Decision Authority: All decisions regarding your warranty claim are made solely by the Third-Party Warranty Company. C&M Mobile Automotive Repairs LLC does not have the authority to make any decisions regarding your warranty claim.
    -Warranty Continuity: By using C&M Mobile Automotive Repairs LLC, you understand that your existing warranty does not reset or start over. The warranty provided by C&M Mobile Automotive Repairs LLC may not serve as an additional warranty to your Third-Party Warranty.
    -Role of C&M Mobile Automotive Repairs LLC: C&M Mobile Automotive Repairs LLC is hired and/or subcontracted by the Third-Party Warranty Company to conduct warranty inspections and/or repairs. C&M Mobile Automotive Repairs LLC does not make decisions on any claims. All claim decisions are handled by the Third-Party Warranty Company.
    -Acknowledgment of Terms: By agreeing to the above and below terms and conditions, you acknowledge and understand that C&M Mobile Automotive Repairs LLC is not responsible for any warranty claim decisions. All claim-related communications and decisions are managed by the Third-Party Warranty Company.
    -Diagnostic and Repair Fees: If your warranty claim is not approved, you will be responsible for the C&M Mobile Automotive Repairs LLC diagnostic fee, plus applicable taxes and other fees. If your warranty claim is approved, the diagnostic fee agreed to during the booking process will not be charged, and C&M Mobile Automotive Repairs LLC will only collect any applicable deductibles once the service is completed.
    -Communication: C&M Mobile Automotive Repairs LLC will handle all communications with the Third-Party Warranty Company to confirm if the repair is covered under your contract and keep you informed throughout the process. By using the services of C&M Mobile Automotive Repairs LLC, you agree to these terms and conditions.
  • 29. "GIFT CARD(S) AND eGIFT CARD(S)"
    C&M Mobile Automotive Repairs LLC now offers eGift cards for purchase, available in preset amounts of $25, $50, $75, and $100, as well as a custom amount option. Custom amounts must be no less than $25.00 and cannot exceed $2,000. All eGift card sales are final, and no refunds of any kind will be issued for purchased gift cards or eGift cards. In the event that a customer requests a refund for a service or product, C&M Mobile Automotive Repairs LLC may offer the refund in the form of a gift card, provided that the customer completes a refund addendum as outlined in Term 7 of C&M Mobile Automotive Repairs LLC Terms and Conditions. By purchasing an eGift card, the customer agrees to these terms and acknowledges that eGift cards hold no cash value, cannot be redeemed for cash, and may only be used towards services or products offered by C&M Mobile Automotive Repairs LLC. Gift cards are only valid in Charlotte, NC, and must be used within our service area, which includes a 25-mile radius of Mecklenburg County.
  • 30. "NOTICE OF SUBCONTRACTOR ENGAGEMENT"
    C&M Mobile Automotive Repairs, LLC (“C&M”) reserves the right to engage qualified independent subcontractors for the performance of certain diagnostic, repair, or maintenance services. These subcontractors operate as independent contractors and are not employees, agents, partners, or legal representatives of C&M. While subcontractors may perform services under the C&M name, they retain control over the manner and means of performing their work, and assume sole responsibility for compliance with applicable laws, licensing, insurance, and regulatory requirements. By accepting services from C&M, the customer acknowledges and agrees that work may be performed by an independent subcontractor. C&M exercises commercially reasonable efforts to ensure all subcontractors meet its standards for skill, professionalism, and conduct, and remains committed to delivering consistent, high-quality service regardless of whether services are rendered by a subcontractor or an internal employee. C&M disclaims any liability for the actions, omissions, or negligence of subcontractors beyond the scope of services directly authorized or controlled by C&M. To the fullest extent permitted by North Carolina law, customers agree to hold C&M harmless for any claims arising from subcontractor performance outside the agreed-upon service scope.
  • 31. "FLEET VEHICLE WARRANTY DISCLAIMER"
    Fleet Vehicle Exclusion from Warranty Coverage-C&M Mobile Automotive Repairs LLC (“Company”) expressly disclaims any and all warranties, whether express or implied, for services provided on fleet vehicles unless otherwise stated in writing and signed by an authorized representative of the Company.
    -Fleet vehicles—including but not limited to those registered, owned, or operated by businesses, rental agencies, or transportation services—are not eligible for the Company’s standard warranty coverage (including the 12-month/12,000-mile warranty), unless a specific written agreement is executed prior to service.
    -Additionally, vehicles serviced under the direction of a third-party fleet management provider (such as Enterprise Fleet Management, ARI, Element, etc.) may be subject to separate warranty terms dictated by those providers. In such cases, the Company assumes no responsibility for warranty disputes or obligations unless specifically contracted and agreed upon in writing.
    -This policy applies to all fleet services performed in the State of North Carolina and is governed under North Carolina General Statutes. Any exceptions to this clause must be clearly documented and retained for verification.
  • 32. "VEHICLE RECORDING & CAMERA POLICY"
    -C&M Mobile Automotive Repairs LLC acknowledges that some customer vehicles may be equipped with dash cameras, security cameras, GPS tracking devices, or other recording equipment, including those with live monitoring and audio recording capabilities. By engaging our mobile services, customers agree to inform our staff in advance if such devices are active during service.-For privacy and safety, C&M Mobile Automotive Repairs LLC reserves the right to disable, cover, or request deactivation of any in-cabin recording devices (particularly audio-enabled devices) during active service or operation of the vehicle by a technician. This measure is to protect employee privacy and ensure compliance with applicable laws.-C&M Mobile Automotive Repairs LLC may also utilize its own video and audio recording equipment during service for safety, training, documentation, and quality assurance purposes. All recordings are maintained in accordance with our privacy policy and applicable law.-North Carolina is a one-party consent state for audio recording; however, out-of-state vehicles may be subject to their own state’s laws. By using our services, you consent to necessary recordings conducted by our staff in the course of business and agree to cooperate in maintaining a safe and respectful work environment regarding all recording devices.
  • 33. "REPAIR LIABILITY TERMS & DIAGNOSTIC DISCLAIMER"
    By authorizing diagnostic or repair services with C&M Mobile Automotive Repairs LLC, the customer acknowledges and agrees to the following terms in full:- All repairs performed by C&M Mobile Automotive Repairs LLC are based on the outcome of a proper diagnostic process conducted by a technician employed by or subcontracted to C&M Mobile Automotive Repairs LLC. Without a complete diagnostic performed by one of these technicians, C&M Mobile Automotive Repairs LLC cannot and will not guarantee the success or effectiveness of any repair or part replacement. If a customer specifically requests a service—such as the replacement of an alternator, starter, battery, or other component—without first authorizing a diagnostic through C&M Mobile Automotive Repairs LLC, the customer accepts full responsibility for the outcome. In such cases, even if the vehicle is not repaired or the original issue persists, the customer remains fully liable for all labor, parts, travel, and service fees that were approved through our estimating system.- C&M Mobile Automotive Repairs LLC uses Shop-Ware, a digital repair management platform, for all service authorizations. All diagnostic and repair work must be reviewed and approved by the customer within the Shop-Ware system before any work is performed. Verbal approvals, text messages, emails, or phone calls do not serve as formal approval for service. Once an estimate is approved in Shop-Ware, it becomes a legally binding agreement for the labor and parts listed, and the customer is responsible for the total cost of those services.- Because of the advanced complexity of modern vehicles, no warranties are offered on diagnostic services, and no refunds will be issued for any diagnostic fees. A diagnostic is a professional, time-based evaluation performed by a technician employed by or subcontracted to C&M Mobile Automotive Repairs LLC using the best information, tools, and testing available at the time. Customers acknowledge that some issues may not be fully identified during the initial diagnostic and that additional diagnostics or disassembly may be required following the initial repair. Should further issues be discovered, the customer will be notified and provided a new estimate via Shop-Ware for review and approval prior to continuation.- In many cases, post-repair retesting is necessary and may be performed by a technician employed by or subcontracted to C&M Mobile Automotive Repairs LLC. This is done to verify that the original complaint has been resolved and to confirm the repair was effective. The need for post-repair testing is not an indication of a faulty repair but rather a critical part of a proper diagnostic process. If new or additional problems are identified during this stage, the customer will receive an updated estimate before further work is performed.- All diagnostic services provided by C&M Mobile Automotive Repairs LLC are final and non-refundable, regardless of repair outcome. Customers agree they are paying for the professional time, tools, experience, and evaluation performed by a technician employed by or subcontracted to C&M Mobile Automotive Repairs LLC—not for a guaranteed solution. Furthermore, customers agree to hold C&M Mobile Automotive Repairs LLC harmless for any incidental or consequential damages related to incomplete or evolving diagnostic findings.- These terms are in full compliance with the North Carolina Motor Vehicle Repair Act (NCGS § 66-28 to § 66-31), which governs consumer rights and business responsibilities during automotive repairs. C&M Mobile Automotive Repairs LLC follows all applicable requirements regarding written estimates, repair authorizations, and billing disclosures.- By approving service through Shop-Ware and receiving service from a technician employed by or subcontracted to C&M Mobile Automotive Repairs LLC, the customer confirms they have read, understood, and accepted these terms and conditions in full.
  • 34. "SHOP-WARE SOFTWARE DISCLOSURE & TERMS"
    C&M Mobile Automotive Repairs LLC (“C&M”) utilizes a third-party software platform known as Shop-Ware to manage customer communication, estimates, invoices, approvals, and service history. The following terms explain how this software is used and clarify our relationship with Shop-Ware in accordance with applicable North Carolina law.- No Affiliation with Shop-Ware, Inc. C&M Mobile Automotive Repairs LLC is not affiliated with, partnered with, sponsored by, or owned by Shop-Ware, Inc. Shop-Ware is an independent software company with its own terms, privacy policies, infrastructure, and website. C&M has no control over Shop-Ware’s website layout, functionality, or data management systems. We use Shop-Ware solely as a tool to deliver estimates, capture approvals, and manage the repair process efficiently and professionally.- Real-Time Approval Tracking for Liability Purposes All interactions within the Shop-Ware system are captured in real time, including the viewing of estimates, approvals of services, and communications between the customer and the technician or service representative. When you approve an estimate using Shop-Ware, that approval is time-stamped and stored within the system. This digital record acts as legal proof of authorization for the work performed. Once an estimate is approved through Shop-Ware, it is binding and cannot be disputed on the basis of a lack of consent. Shop-Ware also records whether a customer has viewed an estimate, providing additional accountability and transparency for both parties.- Data Handling and Privacy Disclosure C&M Mobile Automotive Repairs LLC does not store or control any of the server infrastructure used by Shop-Ware. All customer data—such as estimate history, approval logs, and service records—is securely stored on Shop-Ware’s servers. C&M accesses only the information necessary to perform authorized work. We do not manage or retain sensitive data beyond what is needed to complete the service transaction. All data storage, encryption, and privacy practices are governed by Shop-Ware’s internal systems and their own privacy policy. Customers are encouraged to review Shop-Ware’s terms and privacy practices for more information about how their personal and vehicle data is handled.- North Carolina Legal Compliance C&M Mobile Automotive Repairs LLC complies with all applicable provisions of the North Carolina Motor Vehicle Repair Act (NCGS § 66-28 through § 66-31), which require that repair facilities obtain documented customer authorization before performing services, provide written or electronic estimates when requested, and maintain transparency in pricing and repair documentation. The use of Shop-Ware supports our compliance by offering a secure and verifiable system for customer authorization and communication. By using Shop-Ware in connection with any service provided by C&M Mobile Automotive Repairs LLC, the customer acknowledges and agrees to these terms and accepts Shop-Ware as the official platform for managing repair approvals and service records.
  • 35. "SERVICE AUTHORIZATION TERMS'
    By authorizing any diagnostic or repair service through C&M Mobile Automotive Repairs, you acknowledge and agree to sign and be bound by relevant documentation associated with your repair or transaction. This includes, but is not limited to, the Pre-Service Agreement, AfterPay Payment Contract Agreement, Credit Card Authorization Agreement (for both over-the-phone and in-person transactions), Quick Visual Diagnostic Contract Agreement, Third-Party Warranty Authorization Agreements, SilverRock Email Repair Authorization Agreement, Shop-Ware Digital Approval System Agreement, Final Invoice Acceptance and Payment Obligation Agreement, and any other documentation necessary to complete or process the approved work. These agreements are required to document your informed consent and authorize services in accordance with the North Carolina Motor Vehicle Repair Act (NCGS § 66-28 through § 66-31). You understand that declining to sign or honor these required agreements may result in a delay or refusal of service. All service authorizations and acknowledgments are documented and stored in compliance with the North Carolina Vehicle Repair Act and applicable consumer protection laws.  
  • 36. "LEGAL COMPLIANCE NOTICE"  
    All terms and conditions outlined above are written in accordance with and are fully compliant with the North Carolina Motor Vehicle Repair Act (NCGS § 66-28 through § 66-31). C&M Mobile Automotive Repairs LLC follows all legal requirements regarding estimates, repair authorizations, billing transparency, and customer rights under North Carolina law.
